For Damascius, any attempt to grasp the first principle of all things, the Ineffable, implies the rejection of the principle of non-contradiction (PNC). The reasoning soul, using aporia, is forced to admit contradictory statements as true when it comes to cognising what lies beyond any intelligible being. Damascius shows that it is necessary to postulate a completely transcendent and unknowable Absolute which is the uncoordinated cause of all things beyond the One. This paper examines how Damascius relates the rejection of (...) the PNC and regressive arguments by distinguishing two types of reversal (peritropê) of arguments. This paper begins by analysing: i) Damascius’ first aporia, ii) his characterisation of the first principle as ineffable and iii) its unknowable nature. This leads to some comments about Damascius’ use of predicates and their negations. Finally, the paper distinguishes between regression and reversal to suggest that Damascius’ reversal of the predicates implies that the first principle lies beyond the PNC but does not involve an infinity of first principles. This paper proposes to pose the question of a possible position of Plotinus with regard to the Argument of the Third Man : first, we will examine if it is possible to attribute to Plotinus a position as regards TMA such as it appears in the Parmenides, in particular with regard to the premise which affirms the self-predication of the Forms. Next, we will briefly consider how the question of the soul-body relationship can, to some extent, provide a better understanding (...) of why Plotinus does not bother to give an explicit objection to TMA. Finally, we will analyze how the theory of two kinds of resemblance strikes a fatal blow to the spirit of TMA. (shrink)

Dans cet article, j’examinerai la description du modèle (paradeigma) dans le Timée. Après avoir fait quelques commentaires à propos du contexte dans lequel le modèle est introduit en tant que composante de la sphère intelligible, je poserai la question de l’extension exacte de cette sphère dans le Timée. Puis, je suggèrerai que le modèle peut être défini comme la réalisation optimale d’une fonctionnalité. Cela semble être en effet une alternative crédible afin de comprendre ce que sont les Formes dans la (...) métaphysique de Platon. Néanmoins, cette conception n’est pas exempte de difficultés puisque Platon admet également une conception plus substantielle du modèle dans le Timée (ce dernier élément ne sera pas investigué dans cet article). Cela dit, une vision fonctionnaliste du modèle permet de donner une justification satisfaisante à l’idée selon laquelle le cosmos est la meilleure réalisation démiurgique possible. (shrink)

The rapid and dynamic nature of digital transformation challenges companies that wish to develop and deploy novel digital technologies. Like other actors faced with this transformation, companies need to find robust ways to ethically guide their innovations and business decisions. Digital ethics has recently featured in a plethora of both practical corporate guidelines and compilations of high-level principles, but there remains a gap concerning the development of sound ethical guidance in specific business contexts. As a multinational science and technology company (...) faced with a broad range of digital ventures and associated ethical challenges, Merck KGaA has laid the foundations for bridging this gap by developing a Code of Digital Ethics (CoDE) tailored for this context. Following a comprehensive analysis of existing digital ethics guidelines, we used a reconstructive social research approach to identify 20 relevant principles and derive a code designed as a multi-purpose tool. Versatility was prioritised by defining non-prescriptive guidelines that are open to different perspectives and thus well-suited for operationalisation for varied business purposes. We also chose a clear nested structure that highlights the relationships between five core and fifteen subsidiary principles as well as the different levels of reference—data and algorithmic systems—to which they apply. The CoDE will serve Merck KGaA and its new Digital Ethics Advisory Panel to guide ethical reflection, evaluation and decision-making across the full spectrum of digital developments encountered and undertaken by the company whilst also offering an opportunity to increase transparency for external partners, and thus trust. Recent attempts to develop and apply digital ethics principles to address the challenges of the digital transformation leave organisations with an operationalisation gap. To successfully implement such guidance, they must find ways to translate high-level ethics frameworks into practical methods and tools that match their specific workflows and needs. Here, we describe the development of a standardised risk assessment tool, the Principle-at-Risk Analysis (PaRA), as a means to close this operationalisation gap for a key level of the ethics infrastructure at (...) many organisations – the work of an interdisciplinary ethics panel. The PaRA tool serves to guide and harmonise the work of the Digital Ethics Advisory Panel at the multinational science and technology company Merck KGaA in alignment with the principles outlined in the company’s Code of Digital Ethics. We examine how such a tool can be used as part of a multifaceted approach to operationalise high-level principles at an organisational level and provide general requirements for its implementation. We showcase its application in an example case dealing with the comprehensibility of consent forms in a data-sharing context at Syntropy, a collaborative technology platform for clinical research. RESUMO É certamente hegemônica na recepção do pensamento político rousseauniano, de seus primeiros momentos à exegese contemporânea, a tese segundo a qual o contrato social seria incompatível com a negação do direito natural. A convicção comum a esses intérpretes, herdada da tradição jusnaturalista moderna, é a de que, na ausência de uma obrigação moral prévia - a lei natural - e, portanto, de uma sanção que confira força vinculante à promessa daqueles que se engajam no ato de contratar, o pacto (...) fundamental não passaria de um formulário vão, cujos termos seus celebrantes dificilmente cumpririam. As teorias contratualistas da origem do corpo político encontrar-se-iam, assim, necessariamente atreladas ao jusnaturalismo. Na contramão desse viés de leitura, pretendemos neste artigo desenvolver e sustentar a hipótese de que o contrato social concebido por Jean-Jacques Rousseau, distinto da forma contratual clássica em aspectos cruciais, dispensa a sanção da lei de natureza. Será o caso, para tanto, de esmiuçar a estrutura sui generis do pacto rousseauniano, revelando, finalmente, de onde emana seu poder coercitivo. ABSTRACT The conception according to which the social contract would not be compatible with the refusal of natural right is widely hegemonic in the reception of the Rousseaunian political thought, from its beginnings to the present day exegesis. The common contention of these interpreters, inherited from the modern jusnaturalistic tradition, is that, in the absence of a previous moral obligation - the natural law - and therefore of a sanction able to procure binding force to the promise of those who engage in the act of contracting, the fundamental pact would be but a vain form, whose terms its celebrants would hardly keep. Thusly, the contratualist theories of the origin of the political body would necessarily find themselves linked to jusnaturalism. As a counterpoint to this interpretative bias, we intend in the present article to develop and sustain the hypothesis that the social contract conceived by Jean-Jacques Rousseau, distinct from the classical contractual form in some crucial aspects, dismisses the sanction from the law of nature. To that end, it will be relevant to unravel the sui generis structure of the Rousseaunian pact, elucidating, lastly, the source of its coercive power. (shrink)

This article proposes a reflection on the meaning of the crisis event that is the war in Ukraine, based on the modes of representation through which it was constituted as an image. Starting from a short essay by Merleau-Ponty written at the end of the Second World War, in which the French philosopher reaffirms that the war took place, I intend to critically juxtapose Merleau-Ponty’s attempt to inherit the crisis as a political task and, above all, a philosophical one, with (...) the processes of hyper-representation highlighted by Jean Baudrillard which, on the contrary, operates a subtraction of the event and the real. The proposal is therefore to analyze the non-taking place of events as the impossibility of inheriting a task and a meaning, by showing how such an impossibility manifests itself precisely in the phenomenal space of our contemporary screens. This paper explores the perversion of reality in the context of advanced technologies, such as AI, VR, and AR, through the lens of Jean Baudrillard’s theory of hyperreality and the precession of simulacra. By examining the transformative effects of these technologies on our perception of reality, with a particular focus on the usage of digital avatars, the paper highlights the blurred distinction between the real and the simulated, where the copy becomes more ‘real’ than the original. Drawing on Baudrillard’s (...) concept of hyperreality, the paper delves into the perversion of reality as individuals seek refuge in virtual pleasure paradises and embrace artificial pleasures through their digital avatars, disconnecting from genuine human experiences. The convergence of AI, VR, and AR technologies amplifies this hyperreal condition, where digital avatars mimic or surpass the depth of human relationships, challenging our understanding of what is real. In line with Baudrillard’s theory, the paper explores the objectification and commodification of reality within digital spaces, specifically examining the digital avatars’ role in the erosion of genuine human connections. It explores the implications of these avatars in terms of consent, exploitation, and loss of authenticity, echoing Baudrillard’s concerns about the distortion of reality in contemporary society. Recognizing the implications of these technologies, the paper calls for a critical reflection on their transformative power. It emphasizes the need for a nuanced understanding of the hyperreal condition and ethical responsibility in engaging with AI, VR, and AR, particularly in relation to the usage of digital avatars. By resisting the seductive allure of digital escapism and preserving genuine human connections, we can navigate the perversion of reality and cultivate empathy, compassion, and meaningful interactions that transcend the simulated experiences offered by technology. The purpose of this paper is to show how the interaction between Kantian ethics and some aspects of Heideggerian philosophy can lead to the model of a subject in immediate relationship with others and with his or her community. The positions of Jean-Luc Nancy and Jacques Derrida on this question are presented in contrast with those of Alain Renaut and Emmanuel Lévinas to elucidate their differing ways of interpreting the relationship between Kant and Heidegger with regard to ethics, apriorism, (...) and subjectivity. L’analyse des juristes médiévaux nous montre comment la manipulation des contradictions déontiques prima facie est associée, dans l’argumentation interprétative, à la théorie de la légitimité de la hiérarchie normative, entendue non seulement comme instrument politique mais aussi et essentiellement comme un instrument de rationalité au sein d’une science juridique orientée vers une théologie politique. La notion de droit naturel telle qu’elle apparaît dans certains documents emblématiques dont le Decretum de Gratien du XIIe s., ne peut être réduite au modèle intellectualiste (...) aristotélo-thomiste du XIIIe s. Il y a plusieurs façons de penser le droit naturel dans le monde médiéval chrétien et latin ; elles se maintiennent sur plusieurs siècles et l’une d’elles au moins a des points de contacts et de désaccord avec les traditions juives et musulmanes. Ces courants de pensée qui s’écartent du modèle intellectualiste aristotélo-thomiste peuvent être regroupés au sein d’une famille (au sens wittgensteinien) de modèles volontaristes : les contradictions déontiques peuvent être plus fortes que des contradictions prima facie, elles peuvent être d’authentiques contradictions renvoyant à un nouvel acte de volonté comme la seule façon d’éliminer la contradiction déontique. Cependant, les deux auteurs ne semblent pas assumer jusqu’au bout les enjeux réels posés par la réflexion philosophique de Merleau-Ponty (...) qui, si d’un côté permet certainement de concevoir la pensée et l’expérience en termesd’incorporation, d’autre part, développe une ontologie phénoménologique qui échappe à l’approche réductionniste commun à Varela et Petitot. Dans les deux cas, en effet, le présupposé ontologique est encore dérivé d’une compréhension de la nature comme domaine de la matière comprise en termes déterministes, modèle que l’ontologie phénoménologique de Merleau-Ponty permet au contraire de subvertir. Par conséquent, les fructueuses indications théoriques contenues dans le projet de naturalisation de la phénoménologie doivent néanmoins faire face à une compréhension adéquate de la signification de l’idée de naturalisation, qui soit effectivement phénoménologique en n’acceptant pas de façon acritique aucune option théorique quoique significative.La naturalizzazione della fenomenologia e la natura dei fenomeniIl progetto di naturalizzazione della fenomenologia nasce come tentativo di integrare reciprocamente le neuroscienze e la filosofia fenomenologica. In entrambi i casi infatti il presupposto ontologico è pur sempre ricavato da una comprensione della natura come dominio della materia intesa in senso deterministico, che l’ontologia fenomenologica della natura di Merleau-Ponty sovverte. Pertanto le pur feconde indicazioni teoriche contenute nel progetto di naturalizzazione della fenomenologia devono ancora fare i conti con una adeguata comprensione del significato dell’idea di naturalizzazione, che sia autenticamente fenomenologico nel non assumere in modo inavvertito alcuna opzione teorica per quanto significativa. This article proposes a reading of Ricoeur and Deleuze from their respective interpretations of Spinoza's thought. Ricoeur and Deleuze are placed in the center of the Spinoza-Renaissance that took place in France in the Fifties and Sixties. However, Ricoeur's Spinozism is still largely unknown. The first two parts of the article concern Spinoza's concepts of conatus and essentia actuosa, emphasizing their importance for Ricoeur's hermeneutics of symbols, especially in relation to his reading of Jean Nabert. The following three sections (...) concern Deleuze and the role of Spinoza's thought in the genesis of rhizomatic ontology in Mille plateaux. This book casts new light on the work of the German poet Friedrich Hölderlin (1770 - 1843), and his translations of Greek tragedy. It shows Hölderlin's poetry is unique within Western literature (and art) as it retrieves the socio-politics of a Dionysiac space-time and language to challenge the estrangement of humans from nature and one other. In this book, author Lucas Murrey presents a new picture of ancient Greece, noting that money emerged and rapidly developed there in the sixth century (...) B.C. This act of monetization brought with it a concept of tragedy: money-tyrants struggling against the forces of earth and community who succumb to individual isolation, blindness and death. As Murrey points out, Hölderlin (unconsciously) retrieves the battle between money, nature and community and creatively applies its lessons to our time. But Hölderlin's poetry not only adapts tragedy to question the unlimited "machine process" of "a clever race" of money-tyrants. It also draws attention to Greece's warnings about the mortal danger of the eyes in myth, cult and theatre. Tuttavia entrambi gli autori sembrano non fare fino in fondo i conti con la riflessione di Merleau-Ponty, che se da una parte consente effettivamente di concepire il pensiero e l’esperienza in termini di incorporazione, d’altro canto sviluppa una ontologia fenomenologica che sfugge all’approccio riduzionistico comune a Varela e Petitot. In entrambi i casi infatti il presupposto ontologico è pur sempre ricavato da una comprensione della natura come dominio della materia intesa in senso deterministico, che l’ontologia fenomenologica della natura di Merleau-Ponty sovverte. Pertanto le pur feconde indicazioni teoriche contenute nel progetto di naturalizzazione della fenomenologia devono ancora fare i conti con una adeguata comprensione del significato dell’idea di naturalizzazione, che sia autenticamente fenomenologico nel non assumere in modo inavvertito alcuna opzione teorica per quanto significativa.
